This agreement

These terms are an agreement between you and Abdullah Almethen ("we"), the developer of Span. They supplement Apple's Licensed Application End User License Agreement (the "EULA"), which governs your licence to use Span and applies alongside them. If anything here conflicts with the EULA, the EULA wins. By using Span you accept both.

Who can use Span

Span is for people aged 16 and over. You must be at least 16 years old to use it or to buy Span Plus.

What Span is

Span is a set of games for fun and general wellness. Your Span Score is a game-based estimate against provisional norms. It isn't a medical test and can't diagnose any condition. Worried about your memory or focus? Talk to a doctor.

Scores move with sleep, practice, distraction, your phone and the time of day. We don't promise any particular score, any change in a score, or any result from playing. Don't present a Span result as a clinical assessment of yourself or anyone else.

Span Plus

Span Plus is an optional purchase. It unlocks the full breakdown, the daily session, every game and your trend. The test, your Span Score, Methods and Daily Span stay free.

Plans and prices are shown on the purchase screen in your currency, as the App Store sets them for your country, and that is the price you pay. Payment is charged to your Apple Account when you confirm the purchase or, for a plan with a free trial, when the trial ends.

Free trial. Some plans start with a free trial. Its length, and whether your Apple Account can still get one, are shown before you confirm. Unless you cancel at least 24 hours before the trial ends, the subscription starts and your Apple Account is charged. If you buy a subscription during a free trial, the rest of the trial ends.

Renewal. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends; your Apple Account is charged for the renewal within the 24 hours before the period ends. Manage or cancel anytime in Settings › Apple Account › Subscriptions. Cancelling stops the next renewal, and you keep Span Plus until the end of the period you've paid for.

One-time offer. The first time you close the Span Plus screen after a result, we may show a one-time offer: the annual plan at a lower yearly price, which also applies when it renews, with the same free trial if your Apple Account can still get one. It is shown once.

Lifetime. A lifetime purchase is charged once and doesn't renew.

Creator and gift codes are redeemed through the App Store, and the terms of each code are shown when you redeem it. Restore purchases on any device signed in to the same Apple Account from Settings or the purchase screen. Payments and refunds are handled by Apple under its own policies; we can't issue refunds ourselves.

Your data

There's no account to create. Your scores and settings are stored on your phone, and some usage data is sent to the service providers named in the Privacy Policy, which explains exactly what and why.

Acceptable use

Use Span for your own personal, non-commercial purposes. Don't copy, resell, reverse-engineer or redistribute the app or its games, and don't interfere with the purchase system.

No warranty

Span is provided "as is" and "as available". To the extent the law allows, we make no warranty that it will be uninterrupted, error-free or suited to any particular purpose. Apple has no obligation to provide maintenance or support for Span.

Limitation of liability

To the extent the law allows, Abdullah Almethen is not liable for any indirect, incidental, special or consequential loss, or for lost data, arising from your use of Span, and our total liability to you for all claims is limited to the amount you paid for Span Plus in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, or takes away your rights as a consumer.

Governing law

These terms are governed by the laws of the State of Kuwait. That doesn't remove any protection the consumer law of the country you live in gives you.

Changes

We may update these terms as Span changes, and the date at the top says when they last changed. If a change matters, we'll say so in the app. Using Span after an update means you accept the new terms.
